Well, we have reached the end of our regular sessions, but we will have the opportunity to come back to our discussion on the harmonisation of family law during your presentations. As always, I am including here a couple of links that you might find helpful if doing further research on this topic. First, here is the link to the Commission on European Family Law website, where you can find their Principles of European Family Law Regarding Divorce and Maintenance Between former Spouses, their Principles on Parental Responsibilities, as well as the questionnaires they used for developing them. You can also find a questionnaire on Property Relations Between Spouses, the topic they are currently working with, which will also be a subject of discussion at the 4th Conference of the Commission of European Family Law (which will take place at the University of Cambridge, April 2010).Finally, here is a 2006 article by María Rosaria Marella, titled "The Non-Subversive Function of European Private Law: The Case of Harmonisation of Family Law", which among other things, stresses the ties of family law issues with the market realm and the freedom of contract. And here is a link to a book edited by Pierre Legrand and Roderick Munday (the former author was mentioned several times in class today), titled Comparative Legal Studies: Traditions and Transitions. The book contains an essay by Legrand, titled "The Same and the Different" (p. 240), that touches on some of the author's general critiques to the harmonisation project.
Next week, we will have a guest speaker who will talk to us about Interjursdictional Support Orders, one of the most important aspects of international family law, at least from a practical perspective. The readings for next week will be posted by the end of the week. See you on Wednesday!
